Caprica collects personal information about our subscribers and customers only during registration for our services, and in some cases, during service upgrades.

Caprica respects your right to privacy. The personal information you provide allows us to maintain your account and send you statements, inform you about updates to the service and to notify you of products and services of Caprica, its affiliates and partners that we believe may be of interest to you. Caprica will not distribute or sell your name or any other personal information to third party marketers or advertisers.

Caprica uses reasonable precautions to keep the personal information disclosed to us secure and to disclose such information only to third parties we believe to be responsible. However, we are not responsible for any breach of security or for any actions of any third parties which receive the information. Caprica also provides hosting services to a wide variety of sites, and these sites link to a wide variety of other sites. We are not responsible for the privacy policies of our customers or the sites that they link to or visit, or how they treat information about their users.

Summary of Caprica User Agreement

· Advertisement of products or services for sale on personal web pages are acceptable for light personal and commercial uses. This means no more than an average of 10 individuals coming in per day. If your page consistantly exceeds this limit, we may ask you to discuss the possibility of upgrading to a commercial account designed for your specific needs and budget.

· You agree not to use Caprica to publish libelous or obscene materials, or to publish copyrighted material without the author's consent.

· You and you alone are responsible for your web pages.

· You agree to indemnify Caprica for legal fees or damages arising as a result of your WWW publishing.

· Resale of web space requires a separate written agreement with Caprica.

· Caprica subscribers may use up to 2 MB (5 MB for shell-only accounts) of web space at no additional charge (provided the user disk quota is not exceeded). For additional web space, contact us.

Censorship and Customer Responsibility

Caprica does not censor the content of the data that passes through its networks. However, any activity that utilizes Caprica's networks and services that is reasonably deemed to be illegal will be grounds, at Caprica's sole discretion, for immediate account termination. In addition, Caprica has a policy of zero tolerance for email and usnet spamming, hacking, virus distribution, email/news bombing, email message header forging, ponzi/pyramid schemes, chain letters, copyright infringement, child pornography, and illegal software/technology export. Accounts used for these activities are subject to immediate termination upon detection. It is Caprica's stated policy to cooperate with law enforcement agencies in the investigation of any suspected criminal or civil violation in law.

Caprica subscribers are responsible and accountable for any activity by third parties using their account. You should never share your username or password with anyone. If you ever believe that your username and password have been compromised, contact us and we will issue you new ones.

Caprica has no realistic capability to monitor all activities, transmissions, or content which might violate this policy. Therefore, Caprica does not assume liability to subscribers for violation of Caprica's policies or any applicable criminal or civil code. Caprica reserves the right to make changes to this policy without prior notification to subscribers.
